Macaroni Penguin Play Area Rules

General rules

1. Only children under 6 years old are allowed to play in the soft plat area. Any older siblings must be considered an adult (but still needs to pay accordingly) and may only accompany younger siblings for safety reasons. We reserve the right to ask anyone to leave if their activities become violent or they pose a risk of harm yo young children. 

2. Each play session is restricted to 60 minutes. We will play a tidy-up song 5 minutes prior to the leaving time.

3. Tickets are non-refundable.

4. We may accept ‘walk-ins’ on the day, however, please contact us beforehand to avoid disappointment.

5. Latecomers, either pre-booked or ‘walk-ins’, will not receive additional time.

6. There is no discount for arriving late. Will not receive additional time.

7. We cannot be held responsible for non-arrival. If you are forced to miss your booking because of illness, an accident or traffic, you will not be entitled to a re-booking or refund. Bookings can be moved without question by informing Macaroni Penguin at least TWO FULL DAYS IN ADVANCE.

8. We retain the right to charge a minimum of £100.00 (or the equivalent cost for the damaged items) if damage or soil is caused by your child.

9. If due to special circumstances outside of our control, the play slot must stop before the allotted time, or the venue is being evacuated, we will not hold any responsibility for the reschedule or cancellation.

10. Shoes are not allowed in the play area and must be placed in the cabinets provided. All adults and children must wear socks or tights when entering the play area (by health code).

11. With the exception of baby food and T4 bubble tea/food provided onsite, no food and drinks are allowed in the play area. Please leave all food and drinks outside of the play area, including chewing gum and sweets.

12. Parents and guardians – not Macaroni Penguin staff – are responsible for children and must remain on site at all times and supervise their children. Some toys may be small and need additional, closer, supervision.

13. All guests must wash or sanitize their hands before entering the play area. Please encourage children to use the toilet before playing.

14. Macaroni Penguin is not responsible for any lost, damaged or stolen items. Please keep track of your belongings. Any items left with the venue for more than 2 weeks will be disposed.

15. Macaroni Penguin has a ZERO Bullying policy. Any child or adult seen bullying or harassing others will be asked to leave and will not be entitled to a refund.

16. Children should not climb up onto any tables, chairs, soft play roofs, and any other authorized area.

17. Children who are unwell or become unwell at the play area must not use the play area and leave the venue as soon as possible.

18. Please report any accidents to a member of our staff ASAP.

19. In the event of emergency please evacuate by the nearest door.

20. If you fail to keep to your allotted time, our staff will urge you to vacate the space and this incur charges for any additional unauthorized time used (we do charge £1 for every extra minute). Persistent late finishes may result in future bookings being cancelled. Participation Agreement, Liability Waiver, and Hold Harmless Agreement I, and as parent or legal guardian of the child (or children) whose name is set forth below (each referred to as a “Participant” and collectively referred to herein as the “Participants”) and in consideration of the Participants being permitted to participate in the Activities (as defined below) conducted by Bejoy Ltd agree as follows:

1. Activities – Activities shall be defined as the various activities and services offered to Participants by Bejoy ltd, an indoor playground and bubble tea room.

2. I understand that the employees of Macaroni Penguin are not responsible for Participants who utilize the space and it is the responsibility of the undersigned individual to supervise any minors they bring into the facility.

3. I, and the children under my care, understand and agree to the safety rules and play guidelines. I acknowledge that these rules and guidelines may change and that I have read and am familiar with them prior to entering the play space and making use of the facility.

4. ASSUMPTION OF RISK – In addition to the inherent risk of exposure to COVID-19, I also understand that the Activities entail the risk of severe bodily injury to the Participants. Injuries that could result may vary, but may include (a) minor injuries such as scratches, bruises and sprains; (b) major injuries such as eye injury or loss of sight,  joint or back injuries and concussions; and (c) catastrophic injuries, including paralysis and even death.

5. I understand that, Bejoy ltd cannot eliminate all risks or guarantee the safety of the Participants while Participants participate in the Activities. I have made my own investigation of these risks, understand these risks, and assume them knowingly and willingly on behalf of myself and my minor Participant child. Notwithstanding these  risks and other hazards that may be foreseeable but not specifically identified herein, I, for myself and any minor Participant child, and our respective heirs, personal representatives and assigns, understand, acknowledge, and expressly and voluntarily assume all risks and full responsibility for any sickness or injury arising out of or

related to the Activities.

6. RELEASE, DISCHARGE & AGREEMENT NOT TO SUE – I, for myself and any minor Participant child and our respective heirs, personal representatives and assigns, do hereby release, discharge and agree not to sue Bejoy ltd or its managers, members, employees and/or other agents, for any sickness, injury to or death of any Participant arising, directly or indirectly, from participation in the Activities. This release, discharge and covenant not to sue shall relate to any and all claims or legal rights now existing or arising in the future, including claims and legal rights arising out of any negligence of Bejoy Ltd and/or its managers, members, employees and/or other agents and any other breach of a legal duty arising out of common law, statute, contract or otherwise.

7. Indemnification And Hold Harmless – I agree to indemnify Bejoy Ltd and hold Bejoy Ltd harmless from, without limitation, any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees and costs, incurred due to claims brought by any party as a result of or arising out of my or my minor Participant child’s involvement in the Activities and agree to reimburse Macaroni Penguin for any such costs, expenses and fees as they are incurred.

8. Security Cameras. I understand that security cameras installed around and within Bejoy Ltd facility are for the safety of all participants and may be referenced should any incidents or injury occur.

9. Parent or Legal Guardian Certification and Consent – I hereby certify that I am the parent or legal guardian of the minor Participant children whose name(s) appear below, and I have authority to waive rights on behalf of the minor Participant(s). I have read and I understand all of the provisions of this document and the risks of the Activities. I understand that the Activities could cause injury and even death. I acknowledge that I have read and understand the terms of this document and I am freely and voluntarily signing this document. This Participation Agreement, Liability Waiver, and Hold Harmless Agreement has no expiration date.

10. I understand that this waiver, release of liability and image release is intended to be as broad and inclusive as permitted by the laws of England and Wales (with respect to myself and, if applicable, the child). I further agree that if any part/s of this agreement are held invalid the remainder will continue in full force and effect. Electronic consent Yes, I agree with the above agreement and choose to submit my electronic signature. I certify all the information provided is accurate. I understand that the submission of this form is the legal equivalent of my manual signature. I consent to be legally bound by this waiver's terms as listed above.
